This Privacy Policy explains how Fous Technologies, Inc. (“Fous,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you use Fous API, Fous Studio, our websites, documentation, support channels, and related services (the “Service”).

Fous generally acts as a controller for account, website, billing, security, and business contact information. When a customer submits personal information in API request content and determines why and how it should be processed, Fous may act as that customer's processor or service provider. The applicable contract and law determine the parties' precise roles.

The information we process depends on how you interact with the Service.

• Directly from you, including when you register, configure an organization, fund a wallet, submit an API request, or contact us.
• Automatically from your browser, device, and use of the Service, including through cookies and operational logs.
• From members and administrators of your organization.
• From payment, identity, infrastructure, security, communications, and third-party API providers used to deliver the Service.

• Provide, authenticate, route, execute, bill, support, and maintain the Service.
• Reserve and charge wallet funds, process purchases, issue applicable balance adjustments or refunds, prevent overspending, and maintain transaction records.
• Protect accounts, credentials, providers, customers, and the Service; detect abuse, fraud, and security incidents; and enforce our terms.
• Diagnose errors, measure performance, improve reliability and usability, and develop features.
• Respond to support, legal, privacy, billing, and commercial requests and send service-related communications.
• Comply with law, enforce agreements, establish or defend legal claims, and respond to lawful requests.

Legal bases for EEA and UK users

Where applicable, we rely on performance of a contract, our legitimate interests in operating and securing the Service, compliance with legal obligations, and consent. Where we rely on consent, you may withdraw it at any time without affecting earlier processing. Where we rely on legitimate interests, we balance those interests against your rights and expectations.

Fous sends the data needed to perform a request to the third-party API provider you select. The provider may process that data under its own terms, privacy policy, and customer agreement. You should review those terms before allowing a provider to receive personal or sensitive information.

Fous validates operation access, input, and availability before executing the selected operation. Fous does not use this process to make decisions about people that produce legal or similarly significant effects.

We may disclose information to:

• Third-party API providers as directed by your API and operation selection.
• Vendors that provide hosting, payments, analytics when enabled, communications, support, authentication, fraud prevention, and security services.
• Your organization owners, administrators, and authorized members, according to their roles.
• Professional advisers, auditors, insurers, and financing partners subject to appropriate confidentiality obligations.
• Authorities or other parties when required by law or reasonably necessary to protect rights, safety, and service integrity.
• A buyer, successor, or relevant counterparty in a merger, financing, reorganization, bankruptcy, or transfer of all or part of our business.

We do not sell personal information for money. If we introduce a practice treated as a “sale” or “sharing” under applicable privacy law, we will provide the notices and choices required by that law.

We use essential storage for security, sessions, and consent choices. Analytics and marketing categories remain disabled unless you enable them. Details and controls are available in our Cookie Policy.

We retain information only for as long as reasonably necessary for the purposes described above, including providing the Service, maintaining transaction and security records, resolving disputes, enforcing agreements, and meeting legal obligations.

Retention periods vary by data type and context. We consider account status, the duration of our relationship, customer instructions, provider behavior, legal limitation periods, financial-record requirements, security needs, and whether information can be safely deleted or de-identified. Deletion requests may be subject to legal and operational exceptions.

We use reasonable technical and organizational measures designed to protect information against unauthorized access, loss, misuse, or alteration. No system or transmission method is completely secure, and we cannot guarantee absolute security.

You are responsible for securing your devices, applications, accounts, and API keys. See our Security Overview for more information and vulnerability reporting instructions.

Fous and its providers may process information in countries other than the country where you live. Those countries may have different data-protection laws. Where required, we use recognized transfer mechanisms and supplementary safeguards appropriate to the transfer, such as contractual protections.

Depending on your location and subject to applicable exceptions, you may have rights to:

• Know whether and how we process your personal information and obtain a copy.
• Correct inaccurate or incomplete information.
• Request deletion or restriction of processing.
• Object to processing based on legitimate interests or to direct marketing.
• Receive certain information in a portable format.
• Withdraw consent at any time where processing is based on consent.
• Lodge a complaint with your local data-protection authority.

If California privacy law applies, California residents may have rights to know the categories and specific pieces of personal information collected, the sources and purposes of collection, the categories of recipients, and to request correction or deletion. They may also have rights to opt out of sale or sharing and limit certain uses of sensitive personal information when those practices occur.

The Service is intended for business and developer use and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided information to us, contact us so we can investigate and take appropriate action.

We may update this Policy to reflect changes in the Service, law, or our practices. We will update the date above and provide additional notice when required.
